Privacy Policy Statement

1.      Purpose

Intembeko believes in respecting and protecting Personal Information. The purpose of this privacy policy statement is to provide Intembeko’s clients with a standard of good practice. It is also a constitutional right as well as being a legal and good business practice requirement, which Intembeko takes very seriously. Please refer to the definition of Personal Information at the end of this privacy policy statement. This privacy policy statement is shared with clients and third parties.

2.      Client

For the purpose of this privacy policy statement client refers to:  Intembeko’s contracted corporate clients; and  Any pontetial new clients on whose behalf administration services are to be rendered.

3.      Use of Information

Intembeko collects, uses and keeps Personal Information, as prescribed by relevant laws and regulations, for the purposes of, but not limited to:

  • Carrying out transactions requested by clients and responding to queries;

  • Assisting with the services that the client requires for operational purposes;

  • Confirming and verifying identity and that the client is an authorised user for security purposes;

  • Maintaining client relationships;

  • Audit requirements and record keeping purposes;

  • Possible requirements of the Information Regulator or other government agencies allowed by law, legal proceedings or court rulings.

4.      Intembeko’s Promise

  • Intembeko will not, without prior consent, share information with any third party unless required for assisting the client with solutions or by the law.

  • Intembeko undertakes to receive and process Personal Information that is absolutely necessary for the purpose of; assisting the client with their required services in order to conclude the necessary related agreements and to consider the legitimate legal interests of everyone concerned, as required by the Protection of Personal Information Act.

  • Intembeko undertakes to respect the client’s right to withdraw their consent to the processing of Personal Information.

  • Intembeko undertakes to only use Personal Information for the purpose required to assist and provide services or solutions.

  • Intembeko undertakes to be open and transparent and communicate with its clients as and when required by law regarding the reason for collection and the manner in which Personal Information needs to be collected.

  • Intembeko undertakes to safeguard and protect the Personal Information in it’s possession.

  • Intembeko undertakes to freely confirm the Personal Information held, to update and correct the Personal Information held and to keep it for no longer than legally required. 

  • Intembeko’s employees are obliged to respect the confidentiality of any Personal Information held by Intembeko. Intembeko’s employees are required to sign an employment contract which includes a confidentiality clause.

  • A service level agreement is in place with all third parties to ensure adherence to all privacy policies.

5.      Access to Information

Clients may request a copy of the Personal Information Intembeko holds about the client. Intembeko will take all reasonable steps to confirm the client’s identity prior to providing details of their Personal Information.

Personal Information is defined by the Protection of Personal Information Act (the POPI Act) as:

“means information relating to an identifiable, living, natural person, and where it is applicable, an identifiable, existing juristic person, including, but not limited to— (a) information relating to the race, gender, sex, pregnancy, marital status, national, ethnic or social origin, colour, sexual orientation, age, physical or mental health, well-being, disability, religion, conscience, belief, culture, language and birth of the person; (b) information relating to the education or the medical, financial, criminal or employment history of the person; (c) any identifying number, symbol, e-mail address, physical address, telephone number, location information, online identifier or other particular assignment to the person; (d) the biometric information of the person; (e) the personal opinions, views or preferences of the person; (f) correspondence sent by the person that is implicitly or explicitly of a private or confidential nature or further correspondence that would reveal the contents of the original correspondence; (g) the views or opinions of another individual about the person; and (h) the name of the person if it appears with other personal information relating to the person or if the disclosure of the name itself would reveal information about the person”.
